General Terms and Conditions (GTC) of Atrium Healthcare

1. Scope: 

These General Terms and Conditions (GTC) apply to all contracts, deliveries, and services between Atrium Healthcare (hereinafter “Provider”) and its customers. Deviating terms and conditions of the customer are not recognized unless the Provider expressly agrees to their validity in writing.


2. Services from Atrium Healthcare:

Atrium Healthcare offers consulting and development services in the field of nutritional supplements and healthcare products. The exact scope of services is agreed upon individually with the client.


3. Conclusion of contract:

A contract is concluded when the customer accepts an offer from Atrium Healthcare or a written order confirmation from Atrium Healthcare is received. Verbal side agreements require written confirmation.


4. Prices and payment terms: 

Unless otherwise stated, all prices are in euros plus applicable VAT. Payments are due within 14 days of invoicing without deductions, unless otherwise agreed.


5. Delivery and performance time: 

The agreed delivery and performance deadlines are binding unless unforeseeable obstacles arise for which Atrium Healthcare is not responsible (e.g., force majeure). In such cases, the deadlines will be extended accordingly.


6. Liability: 

Atrium Healthcare is only liable for damages caused by intentional or grossly negligent conduct. Further liability, in particular for lost profits or indirect damages, is excluded.


7. Intellectual Property: 

All content, concepts, and developments created by Atrium Healthcare remain the intellectual property of the provider unless otherwise agreed in writing. Distribution or use by third parties is not permitted without express consent.


8. Data protection: 

Atrium Healthcare processes the customer’s personal data in compliance with applicable data protection regulations. Data will only be shared with third parties if necessary to perform the contract.


9. Image rights: 

All images used on the website are protected by copyright. Some are licensed images from iStock, while others were generated using artificial intelligence. Unauthorized use or distribution of these images is prohibited.


10. Right of withdrawal: 

If the customer is a consumer within the meaning of the German Civil Code (BGB), he or she is entitled to a statutory right of withdrawal. Further information is provided in the separate cancellation policy.


11. Final provisions: 

Should individual provisions of these Terms and Conditions be or become invalid, the validity of the remaining provisions shall remain unaffected. The law of the Federal Republic of Germany shall apply. The place of jurisdiction, to the extent permissible, is Düsseldorf.
